What Is Post-Conviction Relief?
Just know that even though you were convicted of a crime it does not mean that you have to walk around with a black cloud over your shoulder for the rest of your life. Post-conviction relief is exactly what it sounds like. It is relief available to you after you were convicted of a crime that allows you to expunge your record, seal a juvenile conviction, modify a sentence, reduce a felony to a misdemeanor or restore your civil rights.
If this is you, do not delay. There are time limitations as to when relief is available.
VACATING A CRIMINAL CONVICTION
If you did not meaningfully understand the immigration consequences of your guilty plea bargain or no contest, the court may allow you to withdraw your plea and negotiate a more favorable plea with less adverse immigration consequences.
REDUCING A FELONY CONVICTION TO MISDEMEANOR
Certain felony convictions may be reduced to a misdemeanor if you can show that you have successfully completed your probation and you were not sentenced to prison time.
EXPUNGEMENTS
If you are seeking to expunge your criminal conviction to help you with your immigration case, you may want to reconsider given that for immigration purposes an expunged conviction is still a conviction.
If you have completed your probation, you may petition the sentencing court for an expungement of your conviction. If the court grants it, your case will be dismissed, and you will no longer have a conviction for employment, licensing, or residential application purposes.
EARLY TERMINATION OF PROBATION
Being on probation can keep a person from pursuing certain types of employment, licensing, or from traveling out of state. If you have paid the court-imposed fines, have completed your court ordered classes, and have completed the recommended 18 months of probation the court may be inclined to terminate your probation early.
CONVICTION REVIEW
Los Angeles County and other counties throughout California have established departments within the District Attorneys Office that review cases where a person may have been wrongfully convicted. In Los Angeles County, a person can file a claim for review with the Conviction Integrity Unit here.
